Terms of Service

1. Who may use the game

You must be at least 18 years old and legally able to accept these Terms. You must use your own approved account, keep access secure, and provide accurate eligibility and sign-in information.

2. What the game is—and is not

The Happiness Game is experimental coaching software that helps you think through situations. It uses artificial intelligence and may misunderstand you, make mistakes, omit information, or produce something unsuitable.

It is not therapy, medical or mental-health treatment, diagnosis, legal or financial advice, crisis monitoring, or an emergency service. Neither the AI nor human quality review continuously monitors conversations for emergencies. You remain responsible for your choices and for seeking qualified professional or emergency help when appropriate.

3. Beta service

Features may change, fail, pause, or disappear during the beta. AlterAbility may limit access, correct data, or end the beta. We will try to communicate material changes, but we cannot promise uninterrupted availability or that every feature will always be preserved.

4. Your content and permission to process it

You keep ownership of the words and other material you submit. You give AlterAbility a limited, worldwide permission to host, encrypt, copy, transmit, and process that material only as needed to provide, secure, support, and improve the Happiness Game as described in the Privacy Policy.

This permission includes sending relevant content to service providers such as OpenAI and allowing authorized coaches to review ordinary conversations. It does not allow human review of conversations marked Private. The permission ends when the content is deleted, except for temporary provider retention, legal obligations, or information independently held by someone else.

5. Acceptable use

You may not use the service to:

• break the law, threaten, exploit, or harass someone;
• impersonate another person or misrepresent account eligibility;
• try to access another player’s account, Private conversation, or personal information;
• attack, probe, scrape, overload, reverse engineer, or bypass the service’s security or limits;
• upload malicious code or use automated access without written permission; or
• use outputs as a substitute for professional judgment where mistakes could cause serious harm.

AlterAbility may suspend or end access when reasonably necessary to protect people, the service, or legal obligations. You may stop using the service or delete your account at any time.

6. Third-party services

The service relies on providers including Google, OpenAI, DigitalOcean, Cloudflare, Calendly, and YouTube. Their services have separate terms and may change independently. Scheduling through Calendly is voluntary and does not automatically send your Happiness Game conversation or account information to Calendly.

7. The app and AI output

AlterAbility owns The Happiness Game software, design, branding, instructions, and original materials. Do not copy or commercially exploit them without permission. Subject to these Terms and applicable law, you may use AI output generated for you, but similar output may be generated for others and AlterAbility does not guarantee that output can be owned or protected.

8. Disclaimers and responsibility

The service is provided “as is” and “as available.” To the extent the law allows, AlterAbility disclaims implied warranties and is not responsible for indirect, special, incidental, consequential, or punitive losses resulting from use of the beta.

To the extent the law allows, AlterAbility’s total liability relating to the service will not exceed the greater of the amount you paid AlterAbility for the service during the previous 12 months or US $100. These limits do not apply where they are prohibited or to rights that cannot legally be waived.

9. New York law

New York law governs these Terms, without overriding mandatory consumer protections where you live. Before filing a dispute, please email [email protected] so we can try to resolve it informally. Any court proceeding that may legally be brought in New York will be brought in an appropriate state or federal court there. These Terms do not require arbitration or waive participation in a class action.

10. Changes and contact

We may update these Terms as the beta changes. Material changes will be shown in the app and may require renewed agreement. If any provision cannot be enforced, the rest remains in effect. These Terms and the Privacy Policy are the agreement about this service.
